Minimum Requirements of HSSE competence PERSONNEL

1. Education background: Technical school / high school or above qualification

2.Working experience- Have at least 2 years in the

construction industry and 1 year HSSE management working experience. 3. competence:

Shall have a written HSE policy addressing the same objectives as that of the SHELL‟s HSE policy. The HSE policy shall be signed by CONTRACTOR‟s senior management, and widely disseminated and understood among CONTRACTOR‟s personnel.

Shell China HSE Policy & Commitment, Group Golden Rules are included in Appendix 1.

SHELL ENGINEER or his designated ENGINEERs have the right to prohibit commencement of WORKs or to stop any WORKs in progress if the equipment, machinery, personnel or work conditions are considered to be unsafe or not to be in compliance with any applicable HSE rules, regulations and procedures.

Stoppage of the WORK shall be at CONTRACTOR’s expense until CONTRACTOR has satisfactorily rectified such unsafe acts and condition. In the event of serious or repeated infringements, SHELL may terminate the contract without compensation.

and communicate HSE issues, and correct all the issues by following the recommendations in a timely manner according to the degree of concern.

and posses the experience and skill required to perform the WORKs.

Establish and document HSE monitoring programmes and procedures for data collection, interpretation and maintenance.

1.7 Audit

Develop and implement an HSE audit programme and audit follow-up process for SHELL approval.

SHELL reserves the right at any time to independently audit/review/inspect CONTRACTOR‟s facilities, equipment, procedures and HSE management systems against the requirements of the CONTRACT. CONTRACTOR shall fully co-operate with SHELL in such audits and reviews and shall implement recommendations in a timely manner, at its own cost.

2. Contract HSE Plans

The CONTRACTOR shall prepare and submit for SHELL review an HSE plan which covers all WORK under the CONTRACT and, when relevant, legal required HSE documents. This shall be submitted to SHELL prior to the EFFECTIVE DATE of the CONTRACT or when physical work commences, whichever is the earlier.

承包商要准备并提交给壳牌HSE方案，内容包括合同项下的所有工作，包括法律要求所需要的文件，供壳牌审批。这要在合同生效日或现场工作开始前提交给壳牌，以两者中靠前的时间为准。 2.1 Hazard Assessment

CONTRACTOR shall employs best practice methods in identifying, assessing and controlling hazards associated with the WORK prior to or in conjunction with its development of the CONTRACT HSE Plan, especially for the activities of:

These methods shall be documented. Priority should be given to reduce probability, but consequence reducing measures shall be defined in case of failing controls.

It shall also evaluate the adequacy of existing controls and identify and recommend additional methods for managing / minimising the HSE risks.

After conducting a detailed hazard assessment of the WORK, the CONTRACTOR shall develop a CONTRACT HSE Plan in which, as minimum, describes the followings:

- Lost Time Injury Frequency (LTIF)

- Total Recordable Case Frequency (TRCF) - NM/PI report

 Identified all HSE-related activities to be performed during the CONTRACT, including but

not limited to the identification of action parties and specification of completion dates

 Identified and assessed the hazards/risks anticipated during the execution of the

CONTRACT

 How it will manage the identified hazards/activities anticipated, and mitigate risks

associated with the Scope of Work

 How compliance with SHELL‟s requirements will be measured and achieved  HSE improvement initiatives describing any current or proposed HSE improvement

initiatives or programs relevant to the WORK

 Numbers of HSE Advisors to be employed on the CONTRACT, including but not limited

to a description of their roles, responsibilities and deployment

 A description of CONTRACTOR’s HSE audit / inspection / monitoring plans / programs

for the CONTRACT, including a Schedule of HSE management activities to be undertaken during mobilisation, execution of the WORK and demobilisation (e.g. HSE meeting structure and site visits/inspections)

The CONTRACT HSE Plan shall obtain SHELL’s approval prior to the commencement of WORK. The approved CONTRACT HSE Plan shall become part of the CONTRACT documents.

CONTRACTOR shall obtain formal approval from SHELL for any proposed deviations or amendments to the CONTRACT HSE Plan.

HSE会议

CONTRACTOR shall hold regular HSE meetings at different levels of the organization on the following basis, at a minimum:  SITE management meeting Weekly  Toolbox meeting (HSE talks) at site Daily -before starting work  Project management meeting Project close out

Toolbox meetings shall be held by each work team at individual work SITES before commencement of the day‟s activities or prior to each shift. They shall concentrate on the risks of the WORK being undertaken and the precautions necessary to ensure a safe, healthy and environmentally acceptable working day. CONTRACTOR shall maintain records of attendance and submit to SHELL as and when required.

The project management meeting shall be chaired by the CONTRACTOR project manager, and attended by all project management members, and site representatives. Minutes of meeting shall be distributed to the SHELL by the end of the project.

承包商要在不同层面定期召开HSE会议，至少要按照以下频率：  现场管理会 每周一次  现场班前会 每天开始工作前  项目管理会 项目结束时

项目管理会议将由承包商项目经理主持，所有的项目管理人员和现场代表参加。会议纪要要在项目结束时发给壳牌。

4. Competence of Contractor Personnel

承包商人员能力

The CONTRACTOR shall ensure that only competent CONTRACTOR PERSONNEL shall be provided for the performance of the WORK.

The CONTRACTOR shall avoid turnover of CONTRACTOR PERSONNEL where possible and shall obtain SHELL‟s written approval prior to replacing any member of KEY CONTRACTOR PERSONNEL and/or any member of CONTRACTOR PERSONNEL who perform work involving a specific risk.

CONTRACTOR shall, at CONTRACTORs cost, provide qualified HSE Officers who will be responsible to provide guidance and advice pertaining to HSE requirements of works on site.

In addition to the ongoing monitoring of the site, the CONTRACTOR HSE officers at project management level shall also perform a formal inspection of the site at every day to identify and correct any hazardous conditions noted or recommended by SHELL. A written record of all inspections and their status of action follow-ups shall be given to SHELL ENGINEER and SHELL HSE department.

The HSE officers must not be involved or assigned to other part-time work other than as HSE officer.

Prior to start of WORKs, CONTRACTOR shall submit the CV of the proposed HSE officers for SHELL approval. The HSE officers at project management level are required to have at minimum the competence below:

 HSE knowledge and site management

 Adequate coordination and communication skills

 Familiar with computer usage for operation communication and reporting  Self-motivated to follow SHELL‟s HSE requirement and deliver the promises

The total number of HSE officers employed by CONTRACTOR shall be defined in the CONTRACT HSE Plan. Particular attention should be given during start-up of the CONTRACT and the high risk work phase. SHELL may request additional HSE officers at any time.

承包商要确保只有具备能力的承包商人员才能进行工作。

承包商要避免承包商人员的流失在更换关键的承包商人员时要得到壳牌的书面批准，或者承包商的从事涉及到具体风险的任何人员的更换都要得到书面批准。

承包商要提供合格的HSE专员来负责为与现场工作相关的工作提供指引和建议。

除了对现场进行监控外，承包商的项目管理层面的HSE专员每天要针对壳牌所提出的整改要求对现场进行一次正式的检查来发现和改正任何危险的状况。所有的检查都要有书面记录，整改行动的跟进状态要以书面形式反馈给壳牌工程师和HSE部门。

不允许委派HSE专员除做为HSE专员以外的临时性的工作。

在开始工作前，承包商要把准备委任的项目的HSE专员的建立提交给壳牌供批准。HSE专员在项目管理层面至少要具备以下能力：

 HSE知识和现场管理的能力  充分的协调和沟通技巧

 熟悉计算机使用操作，填写报告等

 自我激励来达到壳牌的HSE要求，实现对壳牌的承诺

承包商的HSE专员总数要在合同HSE方案中确定。在合同开始阶段和高风险工作阶段要给予特别关注。壳牌可以随时要求增加额外的HSE专员。

5. HSE Training

HSE培训

承包商要按照附件1中所列的最低HSE培训要求对承包商人员进行HSE培训。在这个附录中所列的课程可以认为是对所有相应承包商人员的强制培训要求。培训费用及资源由承包商承担。

承包商要随时更新合同项下的所有承包商人员的名单，包括他们参加的培训课程可培训日期。这个信息要每周报告给壳牌。

承包商要评估并记录各项工作活动是否需要专门的或额外的培训来应对潜在的风险。如果专项作业涉及到放射性活动，石棉作业，化学品作业，不可接受的噪音工况，或其他的职业病危害，要以书面文件来记录识别、评估和控制这些危害的方法。

CONTRACTOR shall provide, at a minimum, HSE training for CONTRACTOR PERSONNEL in accordance with the Minimum HSE Training Requirements stated in Appendix 1. Courses listed in this Appendix shall be considered as mandatory for all CONTRACTOR PERSONNEL in the Target Population. The training cost will be borne by the CONTRACTOR.

CONTRACTOR shall maintain an up-to-date list of all CONTRACTOR PERSONNEL employed on the CONTRACT, the training courses they have attended and the dates of attendance. This information shall be reported to SHELL on a weekly basis.

Unless specified otherwise herein, all training of CONTRACTOR PERSONNEL shall be at the CONTRACTOR‟s cost.

The CONTRACTOR shall evaluate and document if one of the areas of activity require special or additional training in respect of potential risks. Should the special activity involve radioactivity, asbestos removal, chemicals, unacceptable noise levels or other occupational health hazards, methods for identifying, assessing and controlling such hazards shall be documented.

6. HSE Contract Timeline

6.1 Mobilization For The CONTRACT

合同进场

HSE进场方案

承包商的HSE进场方案要在进场工作开始前得到壳牌的批准。承包商对进场计划的修改或变更都要得到壳牌的正式批准。

HSE启动会议

在进场开始前，壳牌和承包商要召开一个启动会来确定进场及工作开始的相关行动。承包商合同持有人，承包商代表，以及承包商的项目管理的HSE专员都要参加这个会议。

HSE Mobilisation Plan CONTRACTOR‟s HSE mobilisation plan shall obtain SHELL‟s approval prior to the commencement of mobilisation. CONTRACTOR shall obtain formal approval from SHELL for any proposed deviations or amendments to the mobilisation plan.

HSE Kick Off Meeting An HSE kick off meeting to initiate HSE related actions for the mobilization and commencement of the WORK shall be held between SHELL and CONTRACTOR prior to the mobilization. The CONTRACTOR holder, CONTRACTOR representative, and CONTRACTOR HSE officer at project management level shall attend the meeting. 6.2 Operational Period

在开始工作前，承包商要对合同所涉及到的设备和机械进行自我检查，包括但不限于脚手架，电焊机，挖掘机，起重机，压缩机，电线和工具等，以确保工作能够安全进行。检查报告要递交给壳牌。

在承包商明确开工准备工作已经就绪后，壳牌要进行现场安全检查。在检查完成后，检查报告中提出的整改项目都按要求完成后，壳牌会正式通知承包商开始工作。

维护

承包商要有一个预防性的维护计划。所有的维护保养报告要在现场妥善保存。壳牌有权在现场HSE检查和任何需要的时候检查维护保养记录。

个人防护设备

承包商保质保量地发放给合同项下的员工个人防护设备，并要保证这些个人防护设备状态良好。

CONTRACTOR Equipment Safety Inspections Prior to start of WORKs, CONTRACTOR is required to inspect by themselves the equipments and machineries required in connection with the WORKs including but not limited scaffold, electric welding machine, excavating machine, crane, compressor, wirelines, and tools, etc., to ensure that WORKs will be performed under safe condition. The inspection reports shall be sent to the SHELL for review.

SHELL HSE inspection before contract work commencement When CONTRACTOR indicates it is ready to commence the WORK, SHELL shall conduct a site HSE inspection. Upon satisfactory closeout of the recommendations specified in the inspection report, SHELL shall inform CONTRACTOR formally to commence the WORK.

Maintenance

CONTRACTOR is required to have a preventive maintenance plan in place. All maintenance records shall be well kept at site. SHELL shall have the right to check the maintenance records during site HSE inspection or when necessary.

Personal Protective Equipment (PPE) CONTRACTOR shall at its own cost, supply its personnel in connection with the WORKs with adequate and sufficient Personal Protective Equipment and shall ensure that such equipment is maintained in a good condition. Such equipment shall conform to both the SHELL‟s standards,

and shall be used in accordance with the law and good industrial practice. CONTRACTOR shall give instructions for use and shall ensure that SUBCONTRACTORS act likewise.

PPE and maintain enforcement on the use of such PPE. CONTRACTOR shall purchase PPE in accordance with the specification as per Appendix 4.

CONTRACTOR shall submit names of PPE suppliers and PPE samples to SHELL for approval.

Contractor shall obtain written permission from SHELL prior to supply, store and/or use of chemicals on SHELL premises, sites or installations.

Chemical data sheets (Material Safety Data Sheets - MSDS) shall be provided for all chemical products supplied and/or used by CONTRACTOR. Information on all chemicals to be used shall be submitted to SHELL for approval prior to using the chemicals. The MSDS of all chemicals shall be available at site, and understood by all site personnel.

CONTRACTOR shall systematically and regularly evaluate, monitor and document chemical usage to ensure minimal discharges and optimal operation and accurate recording.

All chemicals and chemical containers shall be handled, stored and disposed off according to the safety/standard operation procedures. Eyewash bottles at the construction location and storage areas, must be in place.

Hazardous and Non-hazardous chemicals shall be segregated and stored in marked-off areas with appropriate warning signs.

Tools And Equipments 工具和设备

承包商要确保承包商所有的机械，工具和设备，设施及其它合同项下的项目，不管时购买的还是租赁的，都要保养维护到安全状态，由有资质的人员来操作。工具和设备、机械必须在设计的符合范围内工作。所有的防护设施必须安装并且维持在良好状态。电动工具要满足所使用的危险区域的要求，所有的电缆都是工业用途的。承包商要维修或更换损坏的工具和设备，并自行承担费用。在使用工具和设备时，必须按要求配备相应的个人防护设备。

所有的在易燃气体附近工作的燃油动力设备和电动设备必须装有点火保护装置。

CONTRACTOR shall ensure that all CONTRACTORs machinery, tools and equipment, facilities, and other items associated with the WORKs whether purchased or rented are maintained in a safe condition and to be operated by competent operators. Tools shall only be used for the job they were designed to perform. All guards must be fitted and shall be in good condition at all times. Electrically powered tools shall meet the hazardous zones requirement where applicable. All electric cables shall be industrial type. CONTRACTOR shall repair or replace defective tools and equipment at CONTRACTOR cost. Appropriate personal protective equipment must be worn at all times when using any tool or equipment.

All fuel powered and electrical equipment working in the vicinity of flammable vapours is equipped with proper ignition protective devices.

Site Camp and Offices:

All office/sleeping accommodation shall be provided with air condition to maintain a reasonable temperature if the local climate dictates this requirement.

Air conditioners shall use soft CFC‟s. PRC law requires a min of 18 Deg C. Smoking is forbidden in the construction site area.

The camp and office area shall be kept clean and tidy, free of tripping hazards, free of overhangs or similar which could hit staff heads (areas where these are unavoidable e.g. air conditioners in cabin walls, shall be taped off or otherwise barriered to prevent personal access) Waste shall be disposed of in accordance with any approved ESIA for the project

Permit To Work

工作许可证

CONTRACTOR shall implement SHELL‟s PTW procedure where CONTRACTOR activities require the application of such PTW. This includes but is not limited to project mobilisation, demobilisation, rig up and rig down, rig move, crane operation, hot work, pressurize work operation, lifting, excavation, confined space entry, radiography, electrical permit, lifting, and explosive permit. Authorized SHELL supervisors shall approve the permit. CONTRACTOR shall continuously enforce the conditions of the permits including its validity. CONTRACTOR supervisors shall attend the PTW training and CONTRACTOR is obligated to ensure that CONTRACTOR KEY PERSONNEL have a thorough knowledge of SHELL‟s PTW procedure.

Working at Height

登高作业

在所有距地面距离高于1.8米的左右都要使用全身式双钩安全带，并使用合格的铝制脚手架。

Full body safety harness must be provided for any work to be carried out at a height greater than 1.8 meters above ground or fall on solid base.

Barricade, Platforms And Guardrails

隔离带，平台和护栏

承包商要提供足够的隔离带，盖板，护栏，信号旗人员或其它的相应的警告设施来保护任何在接近危险操作或在高空工作的人员。地面开挖部分上面要铺上牢固的临时盖板并用警示标识清楚标出 。所有的吊装作业区域，过道，平台等，不管是临时的还是永久的，都要用经核准的护栏（包括一个上扶手，中间扶手和脚踏板）保护起来，并要有牢固的工作空间。承包商要提供所有的必要的标识，障碍物，信号旗人员等来保护过往行人受伤。

在临近道路区域的所有警示标识和障碍物要严格遵守国家法律和壳牌的规定。

CONTRACTOR shall provide adequate barricades, covers, guardrails, signal flag persons or other appropriate warning devices to protect personnel near any hazardous operations or overhead work. Temporary covers for floor openings shall be firmly fastened and clearly identified by warning signs. All elevated work areas, walkways, platforms etc. whether permanent or temporary, shall be protected by an approved guardrail (consisting of an upper and intermediate rail and toe board) and shall provide a sturdy working space. The CONTRACTOR shall provide all the necessary signs, barriers, flag persons, etc. to protect the general public from exposure to injury from the WORK.

All legislated and SHELL requirements for warning signs and/or barriers adjacent to public roads must be strictly adhered to.

Compressed Gas Cylinders

压缩气瓶

承包商要确保：

 压缩气瓶的储存，运输和使用要保持垂直位置，并用铁链或其他合适的方式固定在其它实体或

框架上来承受气瓶的重量。不管是空的还是满的气瓶都适用这个规定。  在气瓶未使用是，气瓶阀要关闭，并且气管是减压过的。  其要在运输、储存过程中要配备阀门保护帽。

 易燃气体和氧气瓶是不允许存放在一起的，除非用阻燃墙隔离开。  气瓶必须按照国家或相关标准用颜色区分开来。

CONTRACTOR shall ensure that:  Compressed gas cylinders are stored, transported or used shall be in an upright position

and secured to some substantial object or structure by a chain or other suitable means capable of supporting the weight of the cylinder. This applies to all cylinders, whether empty or full.

 Cylinder valves shall be closed and hoses depressurized when cylinders are not in use.  Cylinders shall have protective valve caps in place while they are being

transported/stored.

 Flammable gases and oxygen cylinders must not be stored in close proximity unless

separated by a non-combustible wall.

 

Cylinders must be identified by a colour code in accordance with COUNTRY or respective national standards.

Gas welding cylinders shall have hose check valve (non-return valves), which allow gases to the blowpipe, but not back from it. Flashback arrestors shall be installed to quench flashback flames and cut off the gas flow automatically, in both oxygen and fuel gas outlet lines.

Emergency Response Preparedness

紧急情况应变准备

承包商要保证现场有足够的紧急应变能力，至少包括：  灭火器及预防火灾

 药品配备足够的急救箱

承包商人员要经过培训，并且能有效使用灭火设备。承包商也要确保急救员接受培训并有能力进行急救。

承包商所有人员要参加定期的防火演练和和培训。

承包商在所有建筑工地要有当班人员挂板，以记录所有的在工地的人员。

承包商要确保所有员工都了解壳牌的紧急应变程序。承包商确保出现紧急情况时所有员工都能按照壳牌的紧急应变程序行动。

壳牌保留指定承包商人员承担紧急应变程序的职责的权力。

CONTRACTOR, at its own cost, shall ensure adequate provision for emergency response at site, which as a minimum, includes the following:  fire fighting & fire prevention  fully equipped first aid kits

CONTRACTOR personnel shall be trained and competent in the use of fire fighting equipment effectively. CONTRACTOR shall also ensure its first aiders are trained and competent to render such services effectively.

All the CONTRACTOR personnel shall participate in periodic drills and instructions in fighting, medivac and any relevant similar activities.

The CONTRACTOR shall have a People On Board in place at each construction site, to record all the people on site at any time.

The CONTRACTOR shall ensure that it is aware of SHELL‟s emergency procedures. CONTRACTOR shall instruct all CONTRACTOR PERSONNEL as to the compliance with SHELL‟s instructions during emergencies.

The SHELL reserves the right to nominate CONTRACTOR PERSONNEL to positions within the (local) emergency response organisation.

Storage/Warehouse 仓储

承包商要确保用可接受的方式来储存现场的原材料，化学用品和燃油。这个原材料存储的要求也包括以下：

 原材料储存在现场指定的位置

 处理和废弃所有的材料的书面记录要在现场保存，随时可以拿到  在所有的存储点必须要做要内务管理

CONTRACTOR shall ensure an acceptable means for storing of material, chemical and fuel on sites. The requirements for storing of materials shall also include the following:  Materials shall be stored at the designated on site location  Written procedures on handling and disposal for all material must be made available  Good housekeeping must be practiced at all storage sites  Storage areas must be located away from vehicular traffic at areas  Storage floors and bins shall be labelled  Storage buildings and warehouses must be provided with an approved lighting, well

ventilated and constructed with fire resistance facilities where appropriate for the chemicals or fuel stored.

 Welding, cutting or any other operations that create sparks must be prohibited inside a

warehouse or near the flammable/combustible material storage yards

 Adequate number of fire extinguishers of appropriate type shall be made available at all

storage areas and warehouses.

 All personnel shall wear approved hard hats while in storage areas.  Flammable and combustible liquids shall be stored separately preferably in storage

buildings

 “NO Smoking” signs shall be posted at storage areas involving flammable and

combustible liquids

Security 安保

承包商要提供足够数量的保安人员和保安措施（如实体围墙）来保护施工工地，防止出现恐吓，损坏和盗窃财产或非批准的进入，动物进入等。承包商保安人员要配备通讯工具来联系承包商管理人员，壳牌，当地警察，以及其它需要的紧急联络方。 承包商要提供岗亭等设施使保安人员能履行工作职责。

壳牌保留要求所有的承包商人员办理许可证才能进入施工现场的权力，无许可证的人员要填写表格得到许可后方可进入。任何不愿遵守上述规定的人员都不得进入施工现场，对于不遵守此规定所产生的任何直接或间接责任壳牌都不会承担。

CONTRACTOR shall provide adequate number of security personnel and security measures(such as physical barriers) to safeguard the WORKSITE from any threat, damage or theft of properties or unauthorized entry, animal entry etc. CONTRACTOR security personnel shall be equipped with communication equipment and able to contact CONTRACTOR management, the SHELL, local police, or other local emergency units as required.

CONTRACTOR shall provide shelter, facilities and amenities to enable such functions or duties to be performed properly.

The SHELL reserves the right to require all CONTRACTOR PERSONNEL seeking to enter a SHELL premises or site to produce a suitable form of identification. Any person not complying or unwilling to comply with the requirements above will not be permitted access to or shall be

Health & Hygiene 健康与卫生

承包商要确保所有的与合同项下相关的工作人员在医学上要适合所从事的工作，身体健康。承包商要负责提供给其员工相应的健康方面的福利并自行承担费用，并负责安排相应的保险来负责医疗救治和住院的费用。

如果承包商的人员有身体上不适合从事相应工作的情况，壳牌保留拒绝这样的员工为壳牌项目工作的权力。

承包商要提供足够的卫生饮料和厕所设施来满足健康和其它法律法规的要求。  毒品及酒精

在现场工作的任何地方禁止使用，销售，分发或持有毒品，麻醉药，酒精饮料。  卫生

承包商要确保现场维持高遂平的卫生状况，尤其是厨师、厨房工作人员，厨房，食品存储区域和宿舍区域。  Fitness to Work

CONTRACTOR shall ensure that all its PERSONNEL engaged in the WORK are medically fit and healthy. CONTRACTOR shall at no cost to SHELL be responsible for the medical welfare of its PERSONNEL and shall take care of arrangements for medical attendance, treatment or hospitalization if and when necessary and will arrange suitable insurance coverage for such contingencies.

If in the opinion of the SHELL, any CONTRACTOR PERSONNEL is not medically fit to work, the SHELL reserves the right to refuse permission for that CONTRACTOR PERSONNEL to work.

The CONTRACTOR shall provide where necessary sufficient hygienic drinking fluids and toilet facilities to meet health regulations and all other legislated requirements.

 Drugs And Alcohol

The use, sale, dispensing or possession of drugs, narcotics and alcoholic beverages is prohibited on site and at any place where the WORK is performed.

 Hygiene

CONTRACTOR shall ensure that the highest level of hygiene is maintained on the site with special reference to food handlers, galley and food storage areas and accommodation areas.

Environmental Management

环境管理

承包商要严格遵守壳牌在环境和废物管理程序的规定。

承包商的所有的废物都要按国家法律法规来处理。承包商尽可能减少废物产生的量。 承包商要分类处理废物，并保存记录。所有的废物处理费用都由承包商。

CONTRACTOR shall strictly adhere to requirements of SHELL Environmental & Waste management procedure.

All waste shall be handled by the CONTRACTOR in accordance with applicable national statutes and regulations. The CONTRACTOR shall act to minimise the total quantity of waste resulting from execution of the WORK.

The CONTRACTOR shall have implemented a system for identifying, classifying and handling waste and keep track record for SHELL review. All the relevant costs shall be borne by CONTRACTOR.

Action to Rectify Breaches 纠正违规的行动

承包商所有的强制执行的行动都要无拖延地报告给壳牌。如果在承包商执行合同项下的工作时出现的任何诉讼、调查行为都要马上报告给壳牌。

如果承包商在执行合同过程中出现任何违反承包商HSE管理系统的情况，承包商将按壳牌规定的日期和改进行动完成整改。壳牌所发的通知将包括签发通知的原因，并列出承包商改进违规将要采取的步骤。

一旦违反以下的救命规则，就需要没有任何争议地采取改进措施，并进行相应惩罚。

Any enforcement action taken against the CONTRACTOR shall be reported by the CONTRACTOR to the SHELL without undue delay. Should a prosecution be commenced under HSE legislation against the CONTRACTOR while performing the WORK, this must also be reported to the SHELL without undue delay.

If the CONTRACTOR is executing the WORK in a manner which, in the opinion of the SHELL, constitutes a breach of any of the requirements of the CONTRACTOR HSE Management System, the SHELL shall advise the CONTRACTOR accordingly by notice in writing and the CONTRACTOR shall correct the situation by the date specified in the notice or disciplinary actions. The notice shall include the SHELL‟s reasons for issuing the notice and outline the steps required of the CONTRACTOR to rectify the said breach.

Below Life saving rules once being breached, disciplinary actions will be taken without any of bargain.

HSE Performance Reporting

HSE表现报告

承包商要报告给壳牌HSE部门：

 每个建筑工程的每周安全会议纪要  每周的HSSE要点

 每月HSE表现数据报告。报告的格式和内容要与壳牌所提供的模版一致

在项目结束时，要提交一份HSE管理总结报告。这个报告至少包括以下内容：  承包商的HSE方案是如何实施的（按照所提交的计划）

 未预见的问题－这些问题是如何解决的，以及建议以后的解决方案  高风险事故隐患的根本原因以及是如何跟进的

 所报告的损失工时事故和与工作相关的疾病事故的根本原因，以及这些事故是如何跟进的  HSE方面做的好的工作，供以后工作借鉴的  设备的损坏和建议避免同样损坏发生的方案  工作中建议改进的方面

 在项目实施过程中壳牌所提出的整改方案以及整改实施情况报告

The CONTRACTOR shall submit to SHELL HSE department:  Weekly safety meeting minutes for each construction site  Weekly HSE highlights  Monthly HSE Performance Data report. The format and content of the report will be the

same as that was used in 2009 issued by SHELL

At the end of WORK completion, an HSE management summary report shall be submitted as the WORK closeout HSE Report. This report must as a minimum address the following:  How the CONTRACTOR‟s HSE plan functioned (where such plan has been drawn up)  Unforeseen problems – how these were overcome and recommended future approaches  Underlying causes of reported high potential incidents and how they have been followed-up.  Underlying causes of reported lost time injuries and work related illness, and how such

cases have been followed-up.

 Positive HSE aspects which should be considered in future activities  Any damage to equipment and recommendations on avoiding similar damage in future

operations

 Suggested improvements to work routines

Incident reporting, investigation, and follow up

事故报告，调查，及跟进

承包商要有一套系统的事故报告程序，并有书面记录，承包商的工作中出现任何中高风险的事故，险肇事故，事故隐患，要立即报告给壳牌。承包商按照壳牌的事故报告程序在规定的时间内提交给壳牌事故报告（用壳牌提供的模版）。

壳牌有权调查任何发生的事故，可以随时随地不受限制地进入承包商和分包商的设备，设施，原材料以及其记录（除非合同约定允许进入）。

承包商要服从并全面配合壳牌的事故调查，必要时参与事故调查。

承包商要实施事故调查中所提出的改进方案，年个确保所发现的问题充分地传达到了服务供应商和分包商的人员处。

The CONTRACTOR shall have a structured and documented incident reporting system, and shall notify the SHELL immediately of any incident, near misses, or potential incident being rated as „high‟ or „medium‟ arising from the CONTRACTOR‟s activities. The CONTRACTOR shall comply with the SHELL‟s procedures when submitting a written incident report (using SHELL‟s incident template) to the SHELL within the timeframe specified in the SHELL‟S procedures.

The SHELL shall have the right to investigate any of the incidents, wherever they occur, and shall have unrestricted access at all reasonable times to the facilities, equipment, materials and records of the CONTRACTOR and the SUBCONTRACTOR(S) for this purpose (subject only to any statutory or contractual obligation prohibiting either access to the facilities or the disclosure of any such records by the CONTRACTOR).

The CONTRACTOR shall comply, and co-operate fully and participate as necessary with the SHELL in any SHELL investigation of incidents.

The CONTRACTOR shall implement all applicable recommendations arising from incident

investigations and shall ensure that the findings are fully communicated to service provider and/or SUBCONTRACTOR PERSONNEL.

HSE Audit, Reviews, and Inspections

HSE审计，回顾，检查

承包商要按照承包商HSE 管理系统的要求或壳牌要求对施工现场进行审计，回顾，检查。

在这些审计，回顾，检查中，承包商要核实满足了所有的法律义务，包括可能的证照的约束，工作是按照合同的所有要求实施的。

The CONTRACTOR shall perform audits, reviews and inspections on the worksite when required by the CONTRACTOR‟s HSE Management System or by the SHELL.

During these audits, reviews and inspections CONTRACTOR shall verify that it has fulfilled any and all legal obligations, including possible stipulations in licenses, and that the WORK is performed in accordance with all requirements of the CONTRACT.

Reports of audits, reviews and inspections shall be submitted upon request, to SHELL.

CONTRACTOR shall co-operate with any HSE audit, review or inspection carried out by SHELL. SHELL shall inform CONTRACTOR on the results. 6.3 Debomilisation on completion of the Operational Period

工作完成后的撤离

当所有的工作完成，或合同终结，承包商要按照合同HSE方案安全地撤离其人员，设备，材料和其它资源。

在承包商履行了所有义务，承包商人员，设备和材料已搬离现场，现场已按所约定的内容恢复好了，撤离才算完成。

When all WORK has been completed or the CONTRACT TERMINATED, the CONTRACTOR shall DEMOBILISE its PERSONNEL, EQUIPMENT, MATERIALS and all other resources safely and in accordance with the HSE CONTRACT Plan.

DEMOBILISATION shall not be considered complete until the CONTRACTOR has met all obligations, and CONTRACTOR PERSONNEL, EQUIPMENT and MATERIALS have been removed from SITE and the SITE (s) restored as specified in Article 8 herein.

7. 承包商HSSE方面终止合同的条款

1. 壳牌公司将每年对承包商的HSSE管理系统进行一次审计。

2. 壳牌对承包商的HSSE管理系统的审计得分如低于60%（满分100％），但高于30％，承包商

要制订整改计划，实施整改措施，三个月后将再次进行审计。如审计得分仍低于60％，壳牌有权终止与承包商签订的工程合同。壳牌对承包商的HSSE管理系统的审计得分如低于30％，壳牌有权直接解除与承包商签订的工程合同。
